The European Union's 2007 Intergovernmental Conferences in Brussels and Lisbon agreed on a new composition of the European Parliament, and on a new voting system for the Council of Ministers. For the legislative period 2009-2014, the seats of the European Parliament are assigned to the 27 Member States following a proposal of the Committee on Constitutional Affairs, plus one additional seat for Italy, here referred to as the "AFCO + 1" seat allocation. Starting in 2014, the Council of Ministers will use a "Double Majority" voting system, whereby an act is adopted if carried by at least 55 percent of the Member States representing 65 percent of the Union's population. The resolution of the European Parliament (2007) draws attention to the overall reform package for the Union's institutions and demands that a future reform should at all events correct any inequalities which have arisen for historical reasons. As a contribution to the prospective debate we here discuss two citizen-based procedures, a "Fix + Prop." seat apportionment for the European Parliament, and the "Jagiellonian Compromise" voting system for the Council of Ministers. A shift to the envisioned citizen-based procedures turns out to go along with a surprisingly balanced compensation of weights, between the European Parliament and the Council of Ministers.

For the election of the European Parliament, the Treaty establishing a Constitution for Europe introduces an absolute novelty, degressive proportionality, while the established principle of electoral equality makes no appearance at all. The normative goals in the Treaty text, when turned into operational electoral rules, entail serious obstacles implying an unnecessary provocation of the electorate. We argue that, since nobody knows its meaning, "degressiveness" ought to be deleted from the text, while the principle of electoral equality, treasured by all Member States, should be included.

Gerade noch rechtzeitig vor der Wahl zum 18. Deutschen Bundestag im September 2013 ist eine fraktionsübergreifend beschlossene Novelle des Wahlrechts in Kraft getreten. Um negative Stimmgewichte ebenso wie verfassungswidrige Wirkungen ausgleichsloser Überhangmandate auszuschließen, wurde das Sitzzuteilungsverfahren unter Beibehaltung des Zweistimmensystems neu geregelt. Künftig wird in einem aufwändigen Rechenverfahren zunächst die Sitzzahl des Bundestages berechnet, bevor diese dann in einer Oberzuteilung auf die Parteien und in Unterzuteilungen auf deren Landeslisten verteilt werden. Die gesetzliche Ausgestaltung dieses Verfahrens lässt mehr noch als sein sachlicher Inhalt Desiderate offen.

Das System des Doppelproporzes für Parlamentswahlen wird erläutert und an Hand von Wahlen in den schweizerischen Kantonen Zürich, Aargau und Schaffhausen illustriert. ; The biproportional seat-apportionment system for parliamentary elections is discussed and illustrated with data from the Swiss Cantons Zuerich, Aargau and Schaffhausen.

Procedural steps for the European Parliament elections are proposed so as to achieve more uniformity among the national electoral provisions of the 27 Member States. The steps include the creation of a European Electoral Authority, the enhancement of the European party system, and the consolidation of the many diverse seat apportionment methods into the single equality-oriented divisor method with standard rounding (Webster/Sainte-Lague). The introduction of semi-open list systems is addressed, as is the formation of a single European constituency for the election of an additional twenty-five MEPs. In the long run the translation of votes into seats could be carried out using the biproportional variant of the divisor method with standard rounding, in order to better mirror the structure of the European Union.

Die vom Bundesverfassungsgericht monierten negativen Stimmgewichte sind als Problem des Bundestags-Wahlrechts weiterhin ungelöst. Im Folgenden wird ein Lösungsmodell vorgestellt, das einige Vorzüge gegenüber den bisher diskutierten Vorschlägen aufweist. Das Verfahren besteht aus drei Schritten: Im Anfangsschritt wird eine anfängliche Sitzverteilung nach dem bisherigen Verfahren berechnet. Fallen dabei Überhangmandate an, so wird im zweiten Schritt – der Anpassungsrechnung - die Bundestagsgröße so lange schrittweise nach oben angepasst, bis alle in der Anfangszuteilung auf die einzelnen Parteien entfallenden Sitzzahlen in der Verhältnisrechnung ihren Platz finden und der Partei-Proporz wiederhergestellt ist. In der Endzuteilung werden die Sitze dann endgültig den Parteien und ihren Landeslisten zugeteilt. Die Analyse der Eigenschaften des Verfahrens zeigt, dass es zahlreiche Vorteile, aber – wie letztlich alle bisher diskutierten Lösungsmodelle – auch spezifische Nachteile gegenüber dem heutigen Wahlsystem hat. Diese Nachteile erscheinen jedoch im Vergleich zu anderen Lösungsoptionen als relativ geringfügig, und können im Übrigen in bestimmten Varianten des Verfahrens weiter abgemildert werden. ; The problem of negative voting weights, as addressed in a July 2008 decision of the German Federal Constitutional Court, still awaits resolution. An amendment of the Electoral Act is proposed that compares favorably with other proposals in the literature. The procedure operates in three steps: The initial step calculates an initial seat apportionment according to current rules. If the initial step leads to overhang seats, a novel second step keeps adjusting the house size of the Bundestag until all initial seats are accommodated by the proportional seat allocation among political parties. The third step finalizes the apportionment by updating the sub-apportionments to the parties' Land lists. The adjustment procedure would seem to come with major advantages, while its disadvantages appear to be minor.

The 2009 European Parliament elections were the largest transnational elections in history. By EU primary law each Member State is allotted a fixed number of seats. Within a Member State, the seat apportionment is governed by national electoral provisions. The national provisions are subject to principles common to all Member States. We present an overview of the 27 national apportionment procedures used in the 2009 elections. Our focus is on the translation of votes into seats, such as electoral thresholds, divisor methods of apportionment, quota methods of apportionment, and single transferable vote systems. Some Member States implement two-step systems comprising a super-apportionment and several sub-apportionments.

The Cambridge Compromise composition of the European Parliament allocates five base seats to each Member State's citizenry, and apportions the remaining seats proportionately to population figures using the divisor method with rounding upwards and observing a 96 seat capping. The power-weighted variant avoids the capping step, proceeding instead by a progressive non-linear downweighting of the population figures until the largest State is allocated exactly 96 seats. The pertinent calculations of the variant are described, and its relative constitutional merits are discussed.

Mit Urteil vom 3. Juli 2008 erteilte das Bundesverfassungsgericht dem Bundestag den Gesetzgebungsauftrag, die als grundgesetzwidrig erkannten negativen Stimmgewichte aus dem Bundeswahlgesetz zu entfernen. Der Aufsatz entwickelt eine neue Reparaturoption, die direktmandatsorientierte Proporzanpassung. Das Verfahren ist frei von den verfassungswidrigen negativen Stimmgewichten und erscheint als direkte Fortschreibung des alten Wahlsystems. Es ist eine mit der Personenwahl verbundene Verhältniswahl und es bewahrt das Zweistimmen-System. Es garantiert jedem Wahlkreissieger das Direktmandat und es gewährleistet einheitliche Erfolgswertgleichheit der Zweitstimmen im gesamten Wahlgebiet. ; In its decision of 3 July 2008 the German Federal Constitutional Court called upon the Bundestag to amend the Federal Election Act (Bundeswahlgesetz) in order to dispose of negative voting weights. The paper presents a novel repair option, the direct-seat oriented proportional fit. The procedure is devoid of negative voting weights and appears as a straightforward adaptation of the old electoral system. It is a proportional representation method combined with the election of persons and it retains the two-ballot system. It guarantees each plurality winner in a constituency a direct seat and it preserves equal success values of list votes (Zweitstimmen) throughout the whole electoral region.
